Rights and responsibilities of a volunteer

A volunteer has the right to:

  • proper conditions for carrying out volunteer activities, in particular, obtaining reliable, accurate and complete information about the procedure and conditions for carrying out volunteer activities, provision of special protective equipment, gear and equipment;
  • inclusion of volunteering time in the educational and industrial practice if it is completed in a direction corresponding to the specialty received, with the consent of the educational institution;
  • reimbursement of expenses related to volunteer activities;
  • other rights provided for by the contract on volunteer activities and legislation.

The volunteer is obliged to:

  • conscientiously and timely fulfill duties related to volunteer activities;
  • in cases specified by law, undergo a medical examination and provide a health certificate;
  • if necessary, undergo further training (retraining);
  • to prevent actions and deeds that may negatively affect the reputation of the volunteer, organization or institution on the basis of which volunteer activities are carried out;
  • comply with the legal regime of restricted information;
  • in the event of concluding a contract for the implementation of volunteer activities and unilateral termination of the contract at the initiative of the volunteer, compensate for direct losses caused by him, if this is provided for by the contract;
  • compensate for property damage caused as a result of their volunteer activities, in accordance with the law.

 

Reimbursement of expenses related to volunteer activities

Volunteers may be reimbursed for travel expenses within the territory of Ukraine and abroad for volunteer activities within the limits of the travel expense reimbursement standards established for civil servants and employees of enterprises, institutions and organizations that are fully or partially maintained (financed) from budget funds.
The volunteer may be reimbursed for the following documented expenses:

  • travel expenses (including luggage transportation) to the place of volunteering;
  • visa costs;
  • food costs when volunteering lasts more than 4 hours a day;
  • accommodation expenses in the event of a volunteer's trip to another locality to carry out volunteer activities lasting more than 8 hours;
  • expenses for postal and telephone services if the volunteer carries out volunteer activities outside the location of the volunteer organization;
  • expenses for medical examinations, vaccinations and other medical and preventive measures directly related to the provision of volunteer assistance.

Reimbursement of expenses may be carried out at the expense of state and local budgets - in the event of concluding an agreement with them on the provision of volunteer assistance, international programs, or an institution or organization with which the volunteer has concluded an agreement on the implementation of volunteer activities, as well as at the expense of other sources of funding not prohibited by law.

Reimbursement of the above expenses is not a volunteer's income and is not a basis for taxation with personal income tax and single social contribution.

Volunteering Agreement

Volunteers provide volunteer assistance on the basis of an organization or institution that involves volunteers in its activities, on the basis of a contract for the implementation of volunteer activities concluded with such an organization or institution, or without such a contract. Volunteers may provide volunteer assistance individually, while they are obliged to inform the recipients of volunteer assistance that they do not cooperate with organizations and institutions that involve volunteers in their activities.

Under a contract for volunteer activities one party (volunteer) undertakes, upon the instructions of the other party (organization or institution that involves volunteers in its activities), to personally provide volunteer assistance free of charge to its recipients within the period established in the agreement, and the specified organization or institution undertakes to provide the volunteer with opportunities to carry out volunteer activities. The agreement may determine the procedure for compensating the volunteer for expenses related to the implementation of the agreement (Part two of Article 9 of the Law of Ukraine “On Volunteer Activities”).

Volunteering Agreement is concluded in writing.

A contract for the implementation of volunteer activities may be concluded with a person who has reached the age of 18. Children who have reached the age of 14 may conclude contracts with the written consent of their parents (adoptive parents), foster parents, foster parents, or guardian.
